New Application Forms.

The National Board of Industrial Property (INPI) has updated the forms for filing trademark applications adapting them to current local practices and enabling the correct identification of the type of trademark to be registered when it is a non-traditional one.
The new forms, which for the time being will coexist with the former ones, allow to state -in addition to word marks, figurative marks and composite marks- if the application corresponds to a three dimensional, sound, scent, tactile or motion mark or even if what is being claimed is the trade dress of a good or service.
This way, the forms are adjusted to local practices. The validity of three dimensional trademarks and those claiming combination of colors are long-standing in Argentina. The first sound mark in Argentina was granted in 2000 (Intel); the first scent mark belongs to L’oreal, 2009, the first motion mark was granted in 2002 in the name of F. Hoffmann La Roche. The registration of different marks that consist of a trade dress is customary, among which we can mention, apart from the ones stated above, the combination of colors applied to the facades or the interior of stores and buildings, means of locomotion, work apparel, sport equipments, as well as any other sign with distinctive capability. Thus, it may now be correctly stated the type of mark involved.
